Notice of Proposed Class Action Settlement

Notice of Proposed Class Action Settlement: If you made a purchase using a credit card at any California Big 5 store between February 14, 2007 and February 23, 2011, and were asked to provide your ZIP code or other personal information, you may be entitled to a Big 5 gift card or merchandise voucher due to a class action settlement in Case No. JCCP 4667 pending in Los Angeles. Big 5 denies liability and denies that anyone has been harmed. The settlement may affect your legal rights. To make a claim, you must file a claim form (with proof of purchase to receive a gift card) by October 28, 2014. If you fail to do so, you will not receive a gift card or merchandise voucher, but you will still be bound by the settlement unless you exclude yourself. If there are unclaimed funds, a donation will be made to charity to guarantee a minimum payout. To object to or exclude yourself from the settlement, you must do so by July 30, 2014. If you fail to do so, you will be deemed to have released Big 5 from all related claims (as described in the full notice), unless you enter an appearance through your own counsel. The Court will hold a hearing on October 1, 2014, to consider whether to approve the settlement. This notice provides only a summary of the settlement.
